Auditor Finds Violation of State Law

Each year, an auditor reviews the district’s accounting practices to see if they comply with the state’s standards and procedures. They analyzed the 2005-2006 budget year.
Act 48 of 2003 says the district may not have more than eight percent of the budget in fund balance.
The auditor found the district exceeded the regulation by $741,000.
The board claimed they knew nothing of Act 48.
The code clearly states on the Pennsylvania Department of Education website,
"For the 2005-2006 school year and each school year thereafter, no school district shall approve an increase in real property taxes unless it has adopted a budget that includes an estimated ending unreserved, undesignated fund balance less than the percentages set forth as follows:
Total Budget Expenditures equal to or greater than $19,000,000
, then the “Fund Balance Limit %, Less Than or equal to 8%.”
The Oley Valley 2005-2006 Total Budget Expenditures were $25,678,823.
Furthermore, the law states,
“By August 15, 2005 and August 15 of each year thereafter, each school district that approves an increase in real property taxes shall provide the Department of Education with information certifying compliance with this section.”
The certification form requires the School Board President, the Secretary of the Board, and the Chief School Administrator signatures.
The board hastily voted to assign the $741,000 into a “designated fund balance”.
The Pennsylvania Department of Education says however, “You are required to formally reopen the budget to account for additional local revenue.”
The directors may create another problem when they “designate” this surplus. It may not belong to the district as they contend, but rather to the taxpayers as part of the tax relief package under House Bill 1.
If there were proper oversight, there would not be these problems. The tax dollars in question could have lowered the 2005-2006 school property taxes, as well.

It is very sad that the people who are so highly paid to ensure that all things are done in compliance with the public school laws and codes have, once again, failed to the detriment of the taxpayers. Does anyone on the board or administration feel any shame or embarrassment over this? Thank God our auditors are honest.

If our administrators were taking care of their first areas of responsibility, instead of gallavanting all over the county and state for meetings and dinners, and across the globe for language related junkets, pesky little nuisances like $700,000+ errors probably wouldn't be happening.

I've said it before, and I'll say it again: If these people worked in the private sector, they'd be fired. Instead, our illustrious board rewards failure with pay raises and extended contracts. And this fiasco is probably only the tip of the iceberg.

How DO they justify all they have done to harm the District and the taxpayers.

Since many taxpayers of our fine Valley are able to listen to WEEU's FEEDBACK program, I think it would be a fine idea to make certain that someone notify the general public on that program, stating the new addition to our school board meetings. Just to be fair, we can ask Mike Faust to inquire about other schools.

Right on Linda, I am still waiting for an answer that I wrote about this morning in the below blog that this money belongs to the taxpayers and we want it. We did not need a tax increase and BB and the rest of them increased us anyway. She said if we did not increase us in June 06 the increase for next year would even be bigger. Instead of talking on the radio everyday for her job why don't she do what is right for the Oley citizens? She was elected by people that she claimed were like her in the way they thought and their concerns, now look at her record.

Hey Dale, since your retired come teach me some grammar! You have alot of nerve commenting continually about my family and I. My kids are smarter then me and definitely are smarter then you. They also tell me everything that is going on in this district. They know what is right with this district and what is wrong. Thank goodness we have an open line of communitation, not like half the kids and their parents. They are proud of my efforts in making this school district accountable. I was involved in this school district with Barb Bieber way before I even met Al Jacobs. She even agreed with him, now she has changed her tune. Also I might not have good grammar but I do think for myself. Al's statements of this blog are not taken from anyone but the board from the meetings and from the administration files and the court house files. Are you telling me they are all wrong?

I can't help but notice the growing number of bloggers that appear to be intimidated by the very presence of Al Jacobs. It's quite noticeable. I should not speak for Al, as he's quite capable of doing so himself. But I will take this brief opportunity to state that for all intents and purposes, Al's information is able to be documented, and he does not hide his sources. If only ALL of our Board were as open and up-front as Al, we would be sipping a Starbucks right now, and watching Bill Mauer, ON DEMAND, instead of blogging.

This is amazing. We are losing American Soldiers every day in Iraq. People are losing jobs in our country, left and right. There's still no real cure for cancer. We're feeding young children "lunchables". We have to fight to say, "Merry Christmas". And thanks to "Capitol One" credit card applications, there's hardly any trees left....

Has anyone heard the story about the turmoil Daniel Boone School District went through years ago? There was much fighting among the board and the taxpayers and nothing was accomplished. The school district as a whole suffered greatly. I hear there was a man who started it all... let's see, what was his name? ...AJ maybe. Well, to make a long story short, AJ has moved away from Daniel Boone, and the district is working together MUCH more peacefully...even the taxpayers groups and the board. Now AJ is up to his anger filled shananigans elsewhere. Hmmm....sound familiar? Go ahead, anger-filled bloggers dish it out to me... I can take it all!!!! :) :) wink winky

According to your ramblings, Al Jacobs (unless there's another AJ you're referring to) must be so very powerful! Turning entire communities against each other. And then, moving to another district to wreak havoc and stir discontent merely by pointing out documentable facts to an otherwise uninformed general public. Imagine that? Well, Winkie-Doodle-Dandy, There's a lot of townfolk that are very busy trying to survive around here. Most are not apathetic to the shEnanigans of this school board. They are too darned tired to attend the meetings, or still working, or tending to their families. Unlike the majority of the school employees, the balance of this community work ALL YEAR LONG. Maybe one or two weeks total vacation time. No SUMMERS OFF. No healthcare benefits akin to the union's demanded package. No assistants to "help" them through their busy days.

This sounds like the diatribe of a person who works as an administrator in another district when he confronted me in the high school parking lot.

He did not like the idea of accountability then and I guess he does not like it now.

Oley Concerned Citizens is not an isolated organization, which worries about keeping their homes or having enough money for the basics in life.

Laws are now in place, which are consistent with the concept of our group that education should be fiscally and educationally accountable.

These laws came into existence not just because of citizens in Oley, but were the result of many taxpayers throughout Pennsylvania banding together and getting involved.

These new standards infuriate the special interests.

They can attack the messenger all they want, but at some point in time, they will get the message times have changed, no more blank check budgets and no more free passes on poor academic performance.

These individuals who use children as hostages to their outrageous demands will resist change by whatever means necessary.

They will attempt to bully, intimidate, and denigrate in an effort to silence and prevent discussions about issues, which will bring about change.

However, the bottom line is that families “suffered” from their greedy agenda long enough.

Someday maybe, Oley will have no millage increase budgets and improving test scores that occurred in another district not too long ago.

Does anyone find it interesting that the board did not have the Budget Committee meeting videotaped?

How convenient that the board didn't tape the conversations relating to the $741,000 and when it is spoken about on the blog, then want to dimiss that this occurred?

I challenge the school board to videotape EACH AND EVERY MEETING, and put this on the school district website for all to see, and not conveniently leaving out all the juicy parts of their ineptness at running a school district and continually having issues with their bookkeeping that are being addressed by the auditor and the State.

Folks, this is not the firs time that this school district has had issues with their record keeping.

Oley has been cited numerous times regarding this issue.

They won't tape and show and tell, because they know what goes on at these meetings, and keeping it as far away from the public's eyes is exactly how they like things.

Did everyone else miss it?

In the post of 11/13/06, in big flashing color, was the amount of $16,455,594

I know you all saw it, but let me refresh your memory.

"This year, they have $16,455,594 sitting in funds. This represents approximately 25.3 mills of taxes! The board's yearly assertion they must raise taxes needs testing against documented, enormous, tax dollar, balances available for use."

Then on 11/16/06 there was another post that made reference to Act 48 and how "The auditor found the district exceeded the regulation by $741,000."

Excuse me, but did that say "regulation"?

Hmmmmmm, then that must mean the remaining $15,714,594 is being held in the "funds" in accordance with the law.

Tell me then, why did the OCC not provide details of act 48 in the post of 11/13/06, instead of allowing the inflammatory comments to rage on? If all that is necessary is to not have more than eight percent of the budget in the fund balance (and I'm sure the OCC knew this on 11/13), then why was everyone lead to believe we need to be up in arms about the entire $16 mil?

Some people do not understand the difference between "balance" and "regulation".

Because they are uninformed they try to create an equation between the two.

This type of math does not work,ask an auditor.

They should take the time to become knowledgable and at least read the blog because the term "balance" was explained to another poster.

Apparently, a $741,000 error is of no concern to the detractors. A good thing the state thinks otherwise.

The state not only put controls on spending, but also on a board tucking away money in an off-budget fund.

These are the laws to the dismay of those who prefer to keep the public in the dark.

Forgive me for using the common sense approach, but a balance is a balance, whether or not the amount is legally what it is supposed to be.

As for a regulation, if only the $741,000 was above what was regulated then the remaining $15 mil must be allowed to be in those funds.

If I am wrong, please give me the particulars on where the above doesn't make sense.

As for the recent OCC posting, that sounds like a political response. It in no way answered the original question.

Okay, so the fund balances are designated for certains uses. That still doesn't explain why OCC...okay, why Al wanted everyone to get upset over the full $16 mil

The board had to "designate" the funds because of the error.

The REAL bottom line, Al Jacobs, is that you have done nothing positive for the Oley Valley School District! All you've done is incite hate and anger. There have been no improvements in taxes or in the relationship between the people and the board. You did much more damage in the Daniel Boone School District WITHOUT any positive improvements for taxpayers or citizens. We can only hope the same doesn't happen here in the peaceful Oley Valley! Somebody sure does have a complex! Is it beneath you to just email Al and get on the actual mailing list? Al's agenda is crisp, clear, and there are no blue cards to be filled out IN FRONT OF ANY AND ALL FELLOW TAXPAYING CITIZENS. No board member will hold up your card in the front of the meeting, look over the top of their glasses, and then mispronounce your name---every single time. Should you question whether they understand your inquiry, don't coun't on eye contact. The board does not look at YOU. Their faces look like they just saw Bigfoot. Once they figure out what your question is, you've got strict limits of time allowed per person. Try accusing Al of that, we'll all laugh like crazy!

For my two cents, which I'm lucky to still have, you're not giving Al or the OCC a fair shake. If you wonder why so many bloggers remain anonymous, you should be answering your own question. How many people want to be laid into the way everyone gets it on here? Your recent badgering is pathetic. Exactly what sort of a diversion are you attempting to cast? Step up to the plate, Mr. Thorozine. Stand next to the Superintendant or the Board President. Ask THEM if they think it's appropriate to toss drug lingo around as you've most recently done. It's not alright with this blogger. Why's that? Because if you are the person you suggested that you were as you signed your initials to the drug joke, then you have little in common with a position which directly deals with the concerns of this community's children.
If a different blogger mistakenly used the incorrect initials, then I extend my apologies, but I offer no apologies for my feeling on joking around about ANY drugs. Even doctors should know better than that.

Why is it liberals demand "tolerance," but only for those with whom they agree?

As to "those who are willing to pay a little more to improve our schools...."

If we actually saw any improvements over the past 25 years of out of control spending, we might view this differently. But the more we spend, the test scores get worse, and the accountability of the administration and board continue to diminish.

Tell the truth, this is not about merely spending a "little" more for improvement, it's about "demanding" that everyone else fulfills personal and unreasonable wish lists, and then treating those people with a complete lack of respect. The criteria for school district’s success vary according to who does the measuring. Some think symbols such as grandiose buildings, state of the art athletic facilities, or public relations are the standards of achievement.

Others however, raise questions whether these symbols are an accurate measurement of success.

If a quality of education at an affordable price is the goal of such a review, then the performance of the district has not been “positive”.

The mere act of presenting public information to the contrary is considered “hate”?

The idea that the community should know about this data is equally upsetting to a few.

The opposition to financial and academic analysis suggests that appearances holds higher value than actual results.

The cost of education is far exceeding its performance. Independent test scores today are not much different than they were six years ago, yet we spent millions for an improvement.

Along the way, hard working families lost their homes. Seniors took less medicine and ate less food. Others are preparing to leave because they project their inability to pay school property taxes.

A number of people throughout the state think that accountability plays an important role in making education better. They think a full review of how tax dollars are spent needs to be part of the solution.

The efforts of those groups must have validity. There are laws recently enacted that now hold school districts responsible for their performance, fiscally and educationally.

A school district can only spend up to an inflation index. They must improve their state assessment test results each year. They can only tuck a certain percentage of tax dollars into a fund balance. In other words, the school districts will have to spend more time being accountable and less time on public relations.

The school board will now have to prioritize their spending. The examination and reflection of that process is not only the right of the community, it is the law.

With all due respect, please explain why it is permissible for board members to speak out of turn, but inexcusable if a person attending a meeting does so.

on several occasions over the past several years.

With all due respect, please explain the reasoning behind the NEW CAMERA MAN. Please inform the taxpaying public when this decision was reached, who is paying for the equipment, and notify all taxpayers if this is a service being donated by the operator of the equipment.

I'm embarrassed every time I have to look senior citizens and struggling young families in the eye, because we ask them to PAY so much, and they get so little.

The seniors are proud and would like less of a burdon with taxes, but most will not proclaim their hardships, they're still trying to make it on their own.

The young couples figure this is the way it is, and pay dearly to have their children educated in the country.

The teachers...just keep on taking from all of us, and are not satisfied. They want more all the time.

When the Reading Eagle wrote that quote from the Dr. The price of the track that the board was talking was $350,000. How did it get up to $1.4 million now? Have the high paid employees follow the same budget principles which the "common man" has to follow, and you'd see plenty of new ideas for cutting costs. The bloated paychecks do nothing to encourage "saving" in any areas.
Look at it this way. If a family (same as a business) has, say, $600 budgeted each month for food store items, and the total monthly cost for the necessities is closer to $725, we, "the common man" have to figure out how to get what we actually "need" with the amount of money we've included in our monthly budget. You can say goodbye to alot of extras to keep your bill close to the $600. Coupons and sale items can help. We do what we have to do.
Why is it so difficult for our "budget department" to do this at the school? It's surprising to see how much you can trim down your "wish list" WHEN YOU HAVE TO.

Get rid of all of the assistants; and make the
building principals and superintendent work a productive day like all of those "they work for."

It's just amazing that the people who say they CAN'T Cut Costs, expect the taxpayers to continually live on LESS. If we can do it, so can they. Maybe if they had to get 2nd jobs to make ends meet, they'd understand what we're talking about. How about the teachers and administrators learn to LIVE ON LESS for a change.

Did ya see in today's paper Daniel Boone School Board is considering refunding the taxpayers a half a mil because they received about $535,000 more state funds than they expected.

Second Question:

Can you imagine how our Administration would act if "we the people" treated them the way they treat us? Going on a blog and blowing off steam is truly our only way to get any of this off of our chests. Going to Board meetings is no different than going into court. You know before you walk in the room, how things will go. The only noticible change the Board has made in the last several years, is to add their camera. Mr. Moser was in charge of the business dept. as interim Business Manager. Did this kind of screw up happen when he was the Business Manager in Boyertown for approx. 35 years? We want to know how $741,000 could not been seen in our budget? We did not need last years tax increase. Do what is right and give the taxpayers of this district a rebate check. This is our money.

I've noticed that this blog has run out of gas in the last week.
Sure, some people are away but it has become redundant and boring.

Real change will not come from some on line thing. You have to work in the 3-dimentional world (go to meetings). I've been to Oley school board meetings and I know that no one goes to them except for Al, Cindy, maybe 2 other alternating regulars, and a few others for the occasional hot issue for one meeting. None of the concerned citizens wants to put in the time to really commit and run for the board.

I have a great amount of respect for board members, especially the newer ones like Mr. Maloney, Mr. Hannum, and Mrs. Bieber (even the lifers like Heckman and Richards) because they have committed to the job, they commit a great amount of time and have subjected themselves to the abuse of people on this blog.
I know all the predictable replies my comment will get from the truth knowers et al.
But keep in mind this bit of truth, unless you actually are elected to school board you will never, never know the truth or understand the underlying factors for school board decisions, or understand why you can't always comment on every issue.

I encourage every one to run for school board. Flood the ballot. Have so many candidates that you increase the odds of new faces winning this time around. You anti-school board people have to think in terms of elections to have impact. You can blog your brains out till dooms day and nothing will happen. It all happens on election day.
But I've read your comments... you will find excuses not to run and then you will comfortably bash the board with ease from your home computer without even having to go to a meeting. How nice for you.
At the very least the current board members took action, got in the game and put their names on the line and committed to doing the job.
Will you?

You are exactly correct and the replies you received proove it.
The tunnelvisioned Concerned Citizen drones have no clue how a school district functions and they are too comfortable as you say, to actually give the effort to gain access to the true workings of the school board. It seems to me that they just enjoy their little chat room here where they can endlessly abuse the school district. It would be much too large of a sacrifice to give up the comfort of the home PC where they can roll their lumpy rear ends to the fridge anytime they need a carb injection. God forbid they spent four or 5 evenings a month at a meeting until 9 or 10PM.
The Concerned drones don't get it that you have to get on the board to have any influence. You may influence the board if you are a reasonable person who presents issues in a sensible manor more than once. Oh sure now they will say that every board member is hostile and the make faces at you etc etc. I know a few of these board members personally and I've been to meetings and they allways are pleasant and respectful of those attending.
My point is that you are correct, you must be on the board to have the greatest influence on the school district.

If the board spends the $741,000 on a special interest wish list item then they are trying to buy off potential candidates from running for school board. Dale is used to this tactic and so is Heckman. The money will be going to the football, pool or whoever is a concern with the current board who want to re-run. DB is giving the money back to their taxpayers we need to do the same.

We have been going to board meetings for over 5 years and when you see nothing getting done and mishandling of funds continue to happen and big raises are given for poor results, why would you want to keep coming to meetings? Change something for the better, be nicer to the citizens that do show up, start being held accountable for your voting records, use our money for education first, give the public a no tax increase for once, then maybe you would see more people coming to meetings. Anyway you enjoy not seeing us a the meetings! We bother you by our questioning and concerns of this district. Often, people in elected positions feel the need to justify their newfound power. If it's something they're not used to, it can become uncomfortable for those participants which would like to keep things civil. Anyone who's been around the country and attended various types of school board meetings can understand the confusion and upset voiced by the taxpayers. This group is a good start. It needs a push to get more people involved. It needs more people that are not intimidated by the towering figures which abound in small towns. Pillars of the community often have cracks in their foundations. Watch them closely.

School boards are no exception.

In addition to the laws are standards each district must meet.

I would like to counter what some of the pro-board bloggers have commented on previously.

I believe they asked what some members of the community have found and what tasks need to be done to try and curb school spending, and one area that was commented on has been addressed.

It seems that the school district is now keeping track of the teacher's time off including their sick time, personal time, emergency time, etc. It is now computerized, and will be tracked.

This is a little scary, as evidently this has not been monitored in the past, which means that a good chunk of money has ignorantly been paid over the past eight or so years without regard to any time off being monitored and many subsitutes and floaters being called in with the taxpayers money being abused with a we don't care attitude.

I guess what the public doesn't know, can't hurt them.

On another front, it seems that some teachers who left the district, owe the district some tuition paid moneys back to the school district, per the terms of their contract, and now we have to go to court over this little item.

This also tells one that obviously the school district has just paid money out in the past, and if the teacher left, so be it.

Another issue that was brought to the attention of the district by a taxpayer.

Had this not been mentioned at a board meeting, these teachers would never have to give this money back.

It all adds up!

Everyone is holding the school board responsible for the fiscal mismanagement and that might be true. However, in the business world, the CEO would be held accountable and promptly fired by the board of directors. Dr. Zackon should be the one to explain what happened and be held responsible. The board could show leadership and courage by firing Dr. Zackon.
Boards come and go but the one common thread though years of mismanagement is the superintendent.

The board voted to assign the $741,000 into a "designated fund balance" for the announced purpose of covering any cash flow shortfall caused by House Bill 1.

However, if the community does not approve the local earned income increase referendum, then the $741,000 is for any purpose.

The district estimates there will be a 4.1% millage increase in the 2006-2007 budget. This represents approximately $675,000 of additional tax dollars.

They could have the $741,000 to use towards the $675,000.

This $741,000 will be in addition to the millions stashed in off-budget funds.

Once again, we could have a no tax increase budget, and still have enormous sums of money for education.

Local property tax relief must be part of the board dialogue on the use of these surplus funds.

As a member of the tax study group I can tell you that we don't know the result and won't until we vote on December 4th. The voting will be done in open meeting (as all votes should been taken) so the result will be known at that time. The Tax Study Commission will formally give it's recommendation to the Board on the 13th. It will be up to the Board, then, to accept or reject that recommendation.
Whatever the recommendation is it will mean a tax increase for many taxpayers in the district. The legislature should be ashamed of itself for pushing this off on the local school districts. By the way, we invited Sen. O'Pake to the meeting on the 4th to give us some insight on the thinking behind Act 1 in Harrisburg but he declined.

Many of us who object to excessive taxation pay for our Christmas presents with cash -- not that it's any of your business at all. What on earth does "personal spending" at Christmas have to do with how much we object to the government's extortion of our private income?

Spoken like a true communist. I think you're in the wrong country, pal; if you think personal budgets and taxation are interchangeable.

Why would one assume that all Christians support the idea behind what is, in fact, the greatest idea that businessmen ever cooked up?

Why would one assume that anyone is dumb enough to charge every item they want?

What does a tax refund have in common with a religious tradition?

You, the cocky blogger, are revealing your imaginary secret identity.

Broaden your horizons:

Many Christians exchange names with their entire family, they give one gift.

Many Christians make their own gifts, which are knows as "gifts from the heart." We hope you don't need an explanation for that one.

Many Christians donate time in hospitals, nursing homes, and at public schools, and they do it all year long.

You can't put a price tag on giving. With a little luck and a lot of prayer, the tax man won't figure out how to tax the joy that fills our hearts when we try to give to those less fortunate.

We're praying for you, oh secret blogger. We pray that you, and many, see the taxation of senior citizens becomming a thing of the past. We're praying that our school board, present and future, see the strain they are helping to place on young families. We're praying for the safety of our young students as they graduate and go out into a world that is, at once, wonderful... and frightening.

You can't stop us from trying to make a better world for our youth.

This is something all school districts are doing now. Check and you will see that the BCIU now has computer tracking systems available for all districts. It just so happens that this is the year it was started. ....no other reason than the fact that it is now available. Check with other districts. You'll find that they are doing it the same way (as of just recently).

Yes, I'm sure there's no other reason that this is being done. After all, the teachers all show up, every day, and never take a sick day unless they are truly ill. Sick days, personal time, emergency time...?

Well, in the "rest" of the working world, we get around 2 personal days a year, and if you call in sick, you'd better be just that. At the end of our careers, we don't get a big, fat check for not taking our sick days. We get the pat on the back, as a means of recognition, that we pretty much came to work, no matter what. And guess what, folks, that's the kind of work ethic our country was founded on. There's one heck of a lot of former Presidents that would cringe at the work ethics in effect today.
Ask not what your country can do for you....
ask how much the taxpayers will cough up... to... silence... your pansy butt.

You wonder about how many screaming for tax rebates are spending for the holidays???

Why not ask this question:

How many very well paid teachers are racking up giant sized charge account bills, even though they earn better than average wages. Let's not forget the comments of the past...when we were told of teachers that need raises to keep up with the cost of living, etc. Oh those poor teachers...perhaps they should find work that lasts 12 months of the years, like the rest of us.

You cannot put Christmas and taxes on the same page. How stupid are you. If you teach your children the real meaning of Christmas, they would be screaming for presents. It is the time of the year to repent and be thankful for how forgiving a Lord we have. Jesus never asks us to fill out a tax form, he only asks us for our devotion.

SHOW ME THE MONEY SCHOOL BOARD IN A FORM OF A TAX REBATE OR A NO TAX INCREASE IN 07-08. THAT WOULD BE THE RIGHT THING TO DO FINALLY. IT IS OUR MONEY TO BEGIN WITH. WITH ALL THESE TOP DOLLAR POSITIONS IN OUR SCHOOL DISTRICT HOW COULD ALL THIS MONEY $741,000 NOT HAVE BEEN KNOWN ABOUT? WE HAD TO PAY ANOTHER PERSON THE AUDITOR TO FIND IT. THIS IS ANOTHER REASON WE NEED ACCOUNTABILITY AND CHANGE IN THIS DISTRICT.
