Each year, an auditor reviews the district’s accounting practices to see if they comply with the state’s standards and procedures. They analyzed the 2005-2006 budget year.
Act 48 of 2003 says the district may not have more than eight percent of the budget in fund balance.
The auditor found the district exceeded the regulation by $741,000.
The board claimed they knew nothing of Act 48.
The code clearly states on the Pennsylvania Department of Education website,
"For the 2005-2006 school year and each school year thereafter, no school district shall approve an increase in real property taxes unless it has adopted a budget that includes an estimated ending unreserved, undesignated fund balance less than the percentages set forth as follows:
Total Budget Expenditures equal to or greater than $19,000,000, then the “Fund Balance Limit %, Less Than or equal to 8%.”
The Oley Valley 2005-2006 Total Budget Expenditures were $25,678,823.
Furthermore, the law states,
“By August 15, 2005 and August 15 of each year thereafter, each school district that approves an increase in real property taxes shall provide the Department of Education with information certifying compliance with this section.”
The certification form requires the School Board President, the Secretary of the Board, and the Chief School Administrator signatures.
The board hastily voted to assign the $741,000 into a “designated fund balance”.
The Pennsylvania Department of Education says however, “You are required to formally reopen the budget to account for additional local revenue.”
The directors may create another problem when they “designate” this surplus. It may not belong to the district as they contend, but rather to the taxpayers as part of the tax relief package under House Bill 1.
If there were proper oversight, there would not be these problems. The tax dollars in question could have lowered the 2005-2006 school property taxes, as well.

MS & CS however have girls there who could benefit from it if they chose to (and if the program gets board approval).
I suggest using a smidgen of logic when conducting your mind-reading exercises.

Hello, BB did not have a daughter 3 years ago interested in volleyball. She is playing this year for the first time in her new school! And yes she is all for it at Oley because her daughter will be coming back and it will be here for her to play. So get your facts straight and do not tell me that my kids could play if they wanted, I would not ask this board for anything but better education even if my kids wanted to play volleyball in the MS. Education and accountability and honesty come first. Have a nice day!

For the record, no Concerned Citizens have asked me a single question about the subject of volleyball.
And had I ever PURSUED a sport for my own children's interests, it would have been tennis.
The term "facts" have quite a loose interpretation on this blog.

HEY Concern citizens for volleyball were at the meeting last night and you spoke to them about the budget. Also you mentioned you were in favor of volleyball at a past meeting. You must of forgot.
Yes, I spoke to concerned citizens, not members of the Concerned Citizens who then went on to presumptively speak in my name. Nor have I forgotten that I was in favor of the volleyball proposal two years ago, nor have I forgotten that choices we make for family members are personal choices and shall remain so.

You are a person in a public position being on this board, so your votes can go public and your addressing concern citizens at meetings can go public. Yes what you do with your family is your own business, but tell the truth and stand up for yourself and your voting record. And yes you were are most likely still are in favor of the volleyball for the MS.
Quite right, and what I said at the public meeting (I believe 11/9/06) was that I am in favor of MS Volleyball. It will come up for discussion again and we will be taking a public vote.
What others choose to attribute to reading my mind, and what they think I may do on private matters is not up for public discussion.

The district knows you pulled your child out, so what no big deal, it is your right. We are saying that volleyball at the MS would benefit her if she came back to the MS or when she comes back to the HS. Board members in the past and present vote for items that benefit their families. It is a known fact. We are there when the votes are being taken. You have voted for things your friends that helped you get into office are against. You have not stood up for the people that have put you into office. You have disappointed alot of people. Your home life and family is your own business. Vote for what you truly believe in not because you do not have a back bone and you are afraid of the newspaper and administrators of this district. Board members are elected to help the people in this community not get kicked out of their homes. Board members are to have fiscal responsibility and accountability. They are not to vote on wish list items. Education must come first. We have alot of educational problems in this district which should be your #1 priority.
